Regulatory Challenges

NELC challenges regulations created by EPA or state environmental agencies when they do not fulfill the written requirements of environmental statutes.

A current example is our recent victory to regulate aquatic pesticides, in which NELC challenged a Bush-era EPA regulation stating that pesticides sprayed into water to prevent the overgrowth of plants or animals did not have to be regulated under the Clean Water Act. Contrary to EPA's thinking, the language of the Clean Water Act does require their regulation, and the current EPA has been charged with creating those regulations to protect our waterways.
